These Terms of Use (“Terms”) govern your access to and use of ACA Way’s event websites, registration pages, mobile/web app, virtual experiences, and related services (collectively, the “Services”). By using the Services or attending the event, you agree to these Terms and to our Privacy Policy.

2) Eligibility & accounts

• You must be at least 18 and capable of entering a contract.

• Keep your login credentials confidential; you’re responsible for activity under your account.

• We may suspend or terminate access for breach of these Terms or harmful behavior.

3) Tickets, registrations & payments

• Ticket purchases and registrations are subject to the pricing, taxes/fees, and options shown at checkout.

• Refunds/changes: Follow the policy presented at purchase. Unless expressly stated otherwise, all sales are final.

• Substitutions: May be allowed (subject to approval and deadlines). Email events@theacaway.com.

• Payments are processed by third-party providers; we don’t store full card details.

4) Program changes, capacity & force majeure

• Speakers, sessions, schedules, venues, and formats may change.

• We may cap attendance or adjust access for safety/operational reasons.

• If events are delayed, rescheduled, moved online, or cancelled due to circumstances beyond our control (e.g., weather, strikes, public health, venue issues), remedies (if any) will follow the policy posted at purchase.

5) Code of conduct

We’re committed to a safe, respectful, harassment-free environment. Prohibited conduct includes harassment, discrimination, intimidation, hate speech, disruptive behavior, and violations of venue rules or law. We may remove anyone—without refund—for violating this Code. Report concerns to staff or email events@theacaway.com.

6) Health, safety & security

Attendees must follow all posted and staff-directed safety rules, including bag checks, badge display, and any screening measures. Don’t bring prohibited items. If you feel unwell, please refrain from attending and contact us for options.

7) Exhibitors, sponsors & badge scanning

If you allow a sponsor/exhibitor to scan your badge or share your profile/contact details in the app, you are providing your information directly to that organization, which will handle it under its own privacy policy. We do not sell your data. See our Privacy Policy for details.

8) Recordings, photography & media release

We photograph and record sessions and common areas. By attending, you grant ACA Way a non-exclusive, worldwide, royalty-free license to use your image/likeness/voice captured at the event for documentation and promotional purposes. If you prefer not to appear, inform staff at registration and avoid camera zones where feasible.

9) Intellectual property & limited license

All event content (presentations, slides, videos, handouts, branding, software, and materials) is owned by ACA Way or its licensors. We grant you a limited, non-transferable license for personal, non-commercial viewing/learning. You may not copy, record, rebroadcast, scrape, train models on, sell, or distribute event content without prior written permission.

10) User content & community features

If you post messages, questions, photos, or other content in the app or virtual platform, you represent you have the rights to do so, that it’s lawful and respectful, and you grant us a license to host, display, and moderate it in connection with the event. We may remove content that violates these Terms or the Code of Conduct.

11) Virtual access & on-demand

For streamed/on-demand sessions, access may be time-limited and geo-limited. Quality depends on your connection and third-party platforms. You may not record or redistribute streams or downloads without permission. We may change or discontinue virtual features at any time.

12) Third-party services & links

Our Services may integrate with or link to third-party tools (e.g., registration/payment processors, event app providers, streaming, maps). We aren’t responsible for third-party terms, policies, or performance. Use them at your discretion.

13) Privacy

Your use of the Services is also governed by our Privacy Policy. We do not automatically add you to ongoing marketing lists; after the event, we will send a one-time email asking if you wish to opt in to communications from us and participating carriers/exhibitors.

14) Disclaimers

The Services and event content are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Educational/industry content reflects speakers’ views, not necessarily ACA Way’s.

15) Limitation of liability

To the maximum extent permitted by law, ACA Way and its officers, employees, contractors, and partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to the event or Services. Our total liability for direct damages will not exceed the amount you paid to ACA Way for the applicable ticket/access.

16) Indemnification

You agree to indemnify and hold harmless ACA Way from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your unlawful conduct, or your misuse of the Services.

17) Accessibility

We strive to provide an inclusive experience. To request accommodations (e.g., mobility access, ASL, dietary needs), email events@theacaway.com as early as possible.

18) Governing law & venue

These Terms are governed by the laws of Florida, USA, without regard to conflict-of-law principles. You consent to exclusive jurisdiction and venue in the state or federal courts located in Miami-Dade County, Florida.

19) Changes to these Terms

We may update these Terms to reflect changes in our Services or applicable law. The updated Terms will be posted with a new effective date. Material changes may be communicated through the Services or by email.
